Protect Our Defenders Files an Amicus Brief Challenging Feres Doctrine in Service Academy Case

Protect Our Defenders filed an Amicus Brief this week in support of a petition by the victim in the ongoing service academy case urging the U.S. Supreme to revisit the Feres doctrine. Feres blocks any service member for suing the U.S. government “for money damages . . . for injury or loss of property, or personal injury or death caused by the negligent or wrongful act or omission of any employee of the Government while acting within the scope of his office or employment.” under the Federal Tort Claims Act (FTCA).

Protect Our Defenders was joined by other advocacy organizations in this brief, arguing that Feres limits victims of military sexual violence from obtaining proper remedy from the military.
