Protect Our Defenders Joins Amicus Brief Supporting Application of Title VII of the Civil Rights Act to Uniformed Members of the Armed Forces

August 13, 2020

Protect Our Defenders joined with the Black Veterans Project in filing an amicus in support of the petitioner’s request for a writ of certiorari by the U.S. Supreme Court. The petitioner argues that Title VII of the 1964 Civil Rights Act, which prohibits discrimination based on racial identity, is not uniformly applied to the Armed Forces. Currently, service members are barred from bringing racial discrimination cases under Title VII against the Department of Defense. The petitioner asks the court to evaluate whether service members should be permitted to bring lawsuits against their employer, the Department of Defense, under Title VII of the 1964 Civil Rights Act.
